Legal Dispute Over Scholarship Funds

In a legal dispute, a Khleeji woman refused to provide her husband with her bank card, obtained through a 4,500-dirham monthly scholarship. Seeking to recover 175,000 dirhams withdrawn from the card over three years, she filed a lawsuit. However, the Ras Al Khaimah Civil Court of First Instance rejected the case when the plaintiff admitted willingly giving her husband the bank card for family needs.

Background of the Lawsuit

The woman, a scholarship recipient earning 4,500 dirhams monthly, accuses her husband of using the card without returning it, despite her repeated requests. She asserts that he withdrew significant sums, totaling 175,000 dirhams, and demands repayment with legal interest.

Legal Proceedings and the Defendant's Defence

The defendant's representative argues that the case falls under the jurisdiction of the Personal Status Court, not the Civil Court. He denies seizing the card and contends the woman permitted access for withdrawals. Seeking dismissal, he claims the lawsuit lacks validity, proof, and evidence, urging the plaintiff to cover legal fees.

Plaintiff's Admission and Court's Rulin

The plaintiff acknowledges providing the defendant with the bank card and PIN willingly, allowing withdrawals for three years to contribute to building a house and meeting family needs. Despite her refusal to file a complaint to preserve marital harmony, the court concludes that the woman authorised the defendant to use the funds for family requirements.

Court's Verdict

The Civil Court of First Instance rules to dismiss the case, maintaining that the plaintiff willingly allowed the defendant access to the funds for family needs. The court orders the plaintiff to cover legal fees and expenses.
